Advocacy groups are key players because they bring most of the lawsuits filed under the provision of the #VotingRightsAct known as #Section2.

But in a #NorthDakota case brought by 2 #NativeAmerican tribes, the 8th US Circuit Court of Appeals ruled that only the #FederalGovernment can sue to enforce the #law.

The decision conflicted with decades of case law. #SCOTUS blocked it in July, allowing the tribes’ preferred maps to temporarily stay in place.

The appeals court’s finding has nevertheless been cited elsewhere, with #Mississippi making a similar argument in another appeal over its state legislative map. #SCOTUS also sent that case back for reconsideration on Monday.

Justice #KetanjiBrownJackson dissented from the decision, writing that both rulings should have been reversed.

Critically, the situation in #Louisiana was already chaos as different courts said that the electoral map was both required AND forbidden.

The Supreme Court ruling brought some order to that chaos, but state officials are still trying to clean up the chaos that existed before the SCOTUS ruling.

This kind of thing has been a longstanding result of the VRA and its interpreters.

It's like Kagan hasn't read Section 2 of the VRA, and that echos the oral arguments where others on both sides of the issue seemed to try to correct her misunderstandings of the statute.

Kagan is wrong on what the law says. People have been citing specific language of the law to try to inform her, but she doesn't seem to care.

It's as if she's just playing the role of a politician unconcerned with reality as she attempts to score political points.
