Since 2014, ⅓ of defendants sentenced to the most serious charge of falsifying business records in the 1st degree in Manhattan received jail time, amounting to less than a year behind bars.
Other defendants received prison time — more than a year’s incarceration — or were sentenced to probation, conditional discharges, community service or fines.
No other defendant in the cases examined received an #UnconditionalDischarge.

The outcome was expected: Last week, in an 18-page decision, Justice #Merchan said that he planned to give #Trump an #UnconditionalDischarge, writing that it “appears to be the most viable solution to ensure finality.”
Trump, who was convicted of 34 felony counts of falsifying business records to cover up a sex scandal, had originally faced probation or up to 4 years in prison, & Justice Merchan had ample ground to consider incarceration.
On Friday, Justice Juan M. #Merchan sentenced Donald J. Trump to an #UnconditionalDischarge, a rare & lenient sentence in NY state courts that still cements #Trump’s status as a #felon before his inauguration.
A conditional discharge would have required him to meet certain conditions, like maintaining employment or paying restitution, but Trump will not be subject to any requirements going forward.
Once he is sentenced, #Trump’s lawyers will have 30 days to file a statement indicating his intent to #appeal. He will then need to mount the actual appeal at New York State’s Appellate Division in Manhattan, & prosecutors will get a chance to respond.
#Legal experts have cast doubt on Trump’s chances of success. Appeals courts typically frown on overturning #jury decisions, barring some glaring error or misconduct by the judge or prosecutors.
That civil action, known as an Article 78 proceeding, will essentially serve as an early #appeal. In the coming weeks, a NY appeals court will begin to consider the proceeding.
In remarks Thursday evening at his Mar-a-Lago estate, #Trump attacked the case & vowed to formally appeal, even though he was expected to avoid #jail or any other substantive #punishment.
“We’re going to appeal anyway, just psychologically, because frankly it’s a disgrace,” he said.
