Why #jurors in the NY #criminal #TrumpTrial can’t have a copy of the #JuryInstructions:

The prohibition against jurors being provided a copy of written #legal instructions comes from a 1987 decision by the #NewYork Court of Appeals in #PeopleVOwens.

The court found that “the distribution of written instructions to the jury is not expressly authorized by #law, & error in such submissions cannot be deemed harmless,” meaning: providing instructions would result in a #conviction being #overturned.

Fmr DC Metropolitan PD Officer #MichaelFanone’s 78-year-old mother was the victim of a #swatting call hours after he spoke outside the criminal #TrumpTrial in #NewYork.

During the #insurrection on #Jan6, Fanone was nearly killed by #Trump supporters while protecting congresspeople & staff inside the Capitol building.

In #NewYork, falsifying records is a #misdemeanor, unless the documents were faked to HIDE ANOTHER CRIME. The other crime, prosecutors say (they also presented evidence of other #crimes), was Trump’s 2016 violation of state #ElectionLaw that prohibited #conspiring to aid a #political campaign using “#UnlawfulMeans.”

It also explains defense’s focus on #MichaelCohen’s credibility & the prosecution’s insistence that his testimony is just one central strand in the broader tapestry of #evidence against #Trump.

If #Trump is #convicted, it will be up to Justice Juan M. #Merchan to decide whether his #punishment will include #prison time.

Trump is charged w/ 34 counts of falsifying business records related to the coverup of a $130k #HushMoney payment that was made to the porn star #StormyDaniels in the days leading up to the #2016election.

All of the charges are class E felonies, or the lowest category of felony in #NewYork State.
